PTA, ICCPR and law of contempt of court are 3 important laws of any state. The ultimate aim of these three laws is to maintain national security, national harmony and national good governance in the state.

Unity among nations is the foundation of national security.  But do the security forces in this country use PTA in a way that preserves the unity among the nations? Sri Lanka’s PTA law is being used in a way that destroys national unity. This writer, who was jailed for 6 months for nothing, is proof of that

Protection of human rights is the foundation of national unity. But are the security forces in this country using the ICCPR in a way that protects basic human rights? Last couple of years  Using ICCPR, Shakthika Satkumara, Sepala and many jailed. Sri Lankan security forces are using ICCPR as a bulldozer that against human rights.

The rule of law is the foundation of the judicial system. That is, the rule of law is the universal set and the judiciary is a subset of it. The facts being so, the law of contempt of court should be used in a way that to protect the rule of law.

No matter state constitution or legal system how profound is,  its effect depends on how it is applied by the rulers. It is a tragedy that Sri Lanka’s political authorities misuse sensitive laws to fulfill  their narrow agendas.

When Parliamentarian Ranjan Ramanayaka  was jailed for contempt of court,  MP Harin Fernando was clad black scarf and performed a childish drama. There, Harin and the Parliament should have done not to wear black scarves but to bring amendments to formalize the law of contempt of court. Ajith Prasanna’s imprisonment for 4 years has made it clear that a black scarf is not the solution to the problem.

We in Sri Lanka should also become a civilized society by closing the loopholes in the law. The responsibility of formalizing the legal system rests entirely with the MPs sent to Parliament for legislation.

Any Member of Parliament in Sri Lanka can introduce a bill on a private level for a new law or amendment. But it appears that no one has fulfilled that responsibility.

Even the JVP members of parliament, who criticize other parties saying that they are different from other politicians, have not fulfilled their basic duty.

A discussion was held today (24) between the secretaries of the political parties  who gave nominations for this year’s local government elections and the Election Commission. Speaking to the Hiru channel after the discussion, the Chairman of the Election Commission, lawyer Nimal Punchiheva, revealed the hidden reality to the media. He said that he also has no confidence in holding the local election.

After the Election Commission announced that the local elections will be held on March 9th, a case has been filed by a retired army colonel demanding that the decision be annulled. The retired colonel has stated in the petition that spending money for the local election while the country is bankrupt will aggravate the economic crisis.

While court hearing the case,it was inquired from the Ministry of Finance whether money can be spent on election or not . In response to that, the Secretary of the Ministry of Finance, replied  the facts through an affidavit and  intimated  the inability to spend money for the election.

The Election Commission has calculated that an amount of 10 billion rupees is needed for the election. Today, the Election Commission has asked the Finance Ministry in writing whether that amount can be given or not.

There is no reason for the Election Commission to receive a different answer in the background that the Ministry of Finance has informed the court in writing  its inability to spend money for the election.

Meanwhile today, Mujibar Rahman filed a Fundamental Rights Petition making several government officials respondents for the non-conduct of the election. 35 persons have been named as respondents in the petition, including  the public administration ministry secretary, the cabinet secretary, the attorney general and the entire cabinet.

It is worth noting although the Election Commission has announced the date of the local government polls, to date  relevant gazette has not been printed .Head of the  Government Press Gangani Kalpana Liyanage has told the media that the Election Commission has not yet made any request whatsoever to print the relevant gazette.

Ajith Prasanna was sentenced to 4 years in prison for contempt of court today. It is true that Ajith Prasanna was a slave to a political family in this country. But as civilized citizens, can we agree about the punishment he received?

Sri Lanka is a very corrupt country, there is no clean mechanism. Sri Lanka is a paradise of thieves, crooks and murderers. Their case files are lying idle and stagnating. Thus, the nakedness of the rule of law revealing to the world.

Earlier, for  the charge of contempt of court Tony Emmanuel, SB Dissanayake, Monk Gnanasara , Ranjan Ramanayaka , etc. have been  jailed .

There is no problem in punishing someone who has committed a crime. But there are 2 things to be said here

1. Hunting individuals for personal or political agendas using the law of contempt of court is not right

2. The lack of a clear framework governing the law of contempt of court needs to be rectified

Contempt of court is well regulated in developed countries of the world. In developed countries,a person who commits this offense is only fined and warned.Punishment like 4 years rigorous imprisonment never inflict.

When a case of contempt of court is directly heard by the Supreme Court, the opportunity to appealing is depriving . The concerned person must go to jail

Reforming the laws of any society is a must. The task of the 225 Members of Parliament is to make specific and practical laws.

It is the irrevocable responsibility of the Parliament to change the inhumane rules. Unfortunately, the Parliament of Sri Lanka is in deep sleep

Sri Lankan people are good in delivering  ‘lorry talks’. There is nothing they don’t know about the economy, politics and  foreign affairs.

Even a person who runs a tea shop in the village should be well aware of its income, expenses and debts. If you don’t understand those numbers, the tea shop will definitely go bankrupt.

The situation in a country is similar. How many people know about Sri Lanka’s GDP, government revenue,  expenditure and debts?

Recently, the American ambassador in Colombo made a frightening statement regarding the Chinese debt.

The Chinese ambassador in Colombo did not stay as mute spectator regarding the American ambassador’s statement.

The Chinese ambassador revealed that it is not the Chinese debt that has burdened Sri Lanka but the commercial debt obtained at high interest.

He also reminded that America is the one who has given large scale commercial loans to Sri Lanka. He further said that the American Hamilton Reserve Bank filed a lawsuit immediately when the Sri Lanka not able to settle dues.

See the diagram above. About half of Sri Lanka’s loans are commercial loans obtained at high interest. According to the Chinese ambassador, those are American loans.

It is worthy to note,  most of these loans were not spent on development projects like highways and power plants. Those were spent on the government’s day-to-day expenses such as paying government salaries and paying off debts.

Regarding the above matter, today the collective of national organizations of Sri Lanka have sent a ear-kissing letter  to the American ambassador.

In relation to the Easter attack, former President Sirisena and others having to pay compensation to the victims has become a news that has attracted attention at local and abroad. The titled case is a fundamental rights petition. Although these cases were filed by the victims of the Easter attack, there was a secret group behind them. The group is as follows

Janath S. Vidanage

The first two cases of fundamental rights cases belonged to Janat Vidhanage. Janath Vidanage was a henchman of Gotabhaya. A member of Viatmaga and Yuthukama organizations.Once Gotabaya came to power he appointed him as the chairman of the Fertilizer Corporation.

Hilmy Ahmed

Hilmy Ahmed is a notorious dealer having no policy. He worked together with LTTE proxies  such as Arne Fjørtoft. He led Young Asia TV and World vision in favor of LTTE terrorists. Hilmy is a  person who secretly dealt with Gotabya  too.

Agulugalle Jinananda Thera

He is a monk who is the executive director of the Buddhist Information Center. Also a monk who contributed to Gota’s political campaign. It is undisputed fact that Jinananda Thero’s actions are a hindrance to religious harmony.

Centre for Society and Religion (CSR)

This is a branch of the Catholic Church. So far, 289 civil cases have been filed  in the District Court against  Sirisena, Pujitha and Hemasiri . The primary objective of these cases is to obtain compensation. Those 289 civil cases have not yet been concluded. If those 289 cases have to be compensated, the current Cross vs Dharmachakra tension will lead to a conflict.

The religious war has begun

A group of senior police officers, including Deshabandu, have told Mahanayake Thero thatbecause they are Buddhists, they are being ill-treated. Sepala has arrested and placed in jail for insulting temple of the tooth relic . Commission have been appointed against Prop. Jerome.

Is it possible to believe the story of the father who went to court when the dead bodies of the children were in the house?

Recently Chamuditha had a conversation with lawyer Gamini Perera. He was the lawyer who represented Janath S Vidanage. He remarked, particular FR was filed  three days after the Easter attack that on April 24. That is, the FR case demanding compensation has been filed even before the last rites of the children  who died in the attack .

Further, During the truth with chamudita program , Chamuditha raised a question about whose conspiracy the Easter attack was. Lawyer Gamini Perera did not answer it and he  replied with another question .

Lawyer Gamini Perera pointed a book titled  ‘Defeating ISIS’ on the bookshelf.It was a book written by a CIA mercenary named Malcolm Nance. ISIS  was created by the CIA. Reading that book is like asking  the thief’s mother to be clairvoyant with regard to the thief’s whereabouts

It is not sure  whether lawyer Gamini Perera turned that  book knowingly or unknowingly. Because if the Easter attack was a conspiracy, this court case is just an extension of it.
