President’s lawyer Mr. Anuja Premaratne, who represented Shafter’s family, informed the Magistrate yesterday (9) that the post-mortem report submitted by the forensic doctor regarding the death of Dinesh Shafter is inadmissible as it is severe contradictory. Addressing the court, President’s Counsel Anuja Premaratne mentioned the following points
1. The judicial officer who visited the death spot has noted that there were two plaster marks, two inches above and two inches below the right shoulder of the deceased
2. There were two redness signs near the left eye and red scratches near the right eye
3. The thumbs of both hands were contained red signs and the backside of the body had red signs, and there were wounds in the middle of the abdomen and on the right leg.
4. Service of Forensic Medical Officer Ruhul Haque, who conducted the post-mortem regarding this death, has been suspended by the Medical Council for a period of 8 months on 20/12/2022.
5. That a person who has taken cyanide should have burns along the veins and there are no such marks.
6. Further that the DNA report regarding the fingernails of the deceased has not yet been received
7. That Dinesh Shafter had attended a meeting of his company at 11.23 pm on the day of his death.
8. The facts presented by the CID and the Medical Examiner regarding the death are contradictory and cannot be accepted.
A note has been found on Dinesh Shafter’s mobile phone which says “Most important who is behind Brian Thomas”. Brian had defrauded Dinesh of Rs 1.4 billion. Although he complained about it to CID, no action was taken until two years passed. Later he was arrested but released on bail of Rs 25000. The police did not object to bail.
